    Our client, the owner of a trade-based business, came to us with a number of legal issues around a potentially non-compliant self-managed super fund, a substantial tax debt (business and personal), and shares issued in the incorrect company name.

    In addressing the issues with the shares, we discovered the solution would not be as simple as having the share register corrected. The shares had been fraudulently transferred to a competitor.

    People often ask me why I left my job with a bigger law firm to start Bayberry & Weir. The answer is simple. I wanted to create and run a business driven by values that were closer to my own. I was uncomfortable with the style of doing business in bigger law firms.

    In a nutshell, I wanted to work in an environment driven by human based values (connection, understanding, transparency) rather than business based values. (profit first, efficiency, productivity)

    I didn’t want to stay in what I felt was a dehumanising environment where everything was either black or white, with nothing in between.

     

    A good legal system vs. great legal system?

    In my opinion there is a distinct difference between a good legal system and a great legal system.

    A good legal system takes into account what’s within the rules and what’s not.

    A great legal system realises that its primary purpose is to serve the people. It takes the values, morals and ethics of its people into account, as well as the rules and strives to be better for both.

    I prefer a great legal system, and come to work every day being the change I want to see in this industry.

     

    The “no win, no pay” culture

    Nowadays many law firms advertise a “no win, no pay” deal for clients. Conditions apply, of course, and there’s very strict selection criteria where only open and shut cases are accepted.

    The problem with this approach is that some of the most important cases are not open and shut, however where one party is still in the right the legal system should recognise this.

    But without legal representation that’s willing to stand by them, will they still reach this result?

    Clients who find themselves in this situation need an experienced lawyer who is passionate and determined about following the case through to get a fair result. These clients need a lawyer who won’t just settle or allow themselves to be bullied by a bigger company or firm.

    These cases light a fire and intrigue within me, and while some lawyers and firms protecting their reputation would advise against representing the client in these circumstances, being a partner at Bayberry & Weir I have the advantage of exercising a personal decision.

    I have a track record in the legal industry of being prepared to take on the tougher cases that a “no win, no pay” firm won’t touch (provided that I feel it’s the right thing to do). I am not in pursuit of another notch in my belt to further my career in the law. Frankly, I don’t need it.

     

    Why I like the tougher cases

    I like cases that are not open and shut for many reasons. First of all, these are the cases that matter, the ones that define the law and add nuance, and often precedent, to our system.

    Not too mention I feel confident when I get to know the client well during the initial consultation and in subsequent meetings. I get to hear the case from a human perspective as well as a legal one.

    If I feel an emotional buy-in to the case and if the case ignites my passion, then I’ll take it on. I want to pursue what’s right and fair for cases that I genuinely care about.

     

    The small firm advantage

    As a partner in my own firm, I can say “yes” to the cases that whet my appetite for justice. I can pursue them wholeheartedly without having my puppet strings pulled by a higher up whose main concerns are the firm’s win record and squeezing billable hours out of the clients.

    Starting my own small law firm has been one of the most satisfying career moves I’ve made. I can practise law in a human and humane way, letting values and morals drive me all the way.

    What I’ve written above might sound like a risky way to do business, but in my opinion it’s what’s right, and what lights me up every day.

    Large law firms and smaller firms both have their place in the legal ecosystem and there are advantages and disadvantages to engaging either one. Let’s take a look at them.

    Advantages of big law firms

    Big law firms are great for big cases. Why? Because big cases often need the resources and high profile that a big law firm can provide, such as a research team and the perception of many great legal minds working on the complexities of the case. A big law firm can project an image of power, deploying bully tactics if required. This may be exactly what some big cases need, but it comes at a hefty price.

    Disadvantages of big law firms

    Not many people would want to “rock the boat” by saying this in print, but here goes…

    Without wanting to sound like we’re berating big law firms, here is a list of their main disadvantages:

    • If you have little confidence and experience in legal matters or the legal process, you can feel like a big law firm is walking all over you.
    • Big law firms have been known to protect their records and churn through cases by settling when they shouldn’t.
    • Big law firms are expensive to maintain and run. To cover their enormous costs, they’re driven by clocking up billable hours, even if the individual lawyer you’re working with is not.
    • Because all staff have to comply with the law firm’s set of values, your representative lawyer probably won’t have the freedom to be human with you.

      Advantages of smaller firms

      Smaller firms in comparison can usually offer the following benefits:

    •  They have more time for you and your legal matter during an initial consultation.
    • With more time and patience for all clients, there is the opportunity to deal with your case with more “human-ness” – in other words, they’ll treat you like a human being.
    • You’ll have easier and quicker access to your representative when you need it.
    • They work with fewer clients at any given time so that they can focus better on you and your case.
    • They charge less because they have fewer employees and their overheads are much lower.

      Disadvantages of smaller firms

      The main disadvantage of smaller firms is that they lack the resources to handle large, lengthy legal cases.

      A short story 

      Once upon a time when people went to the bank, they used to get their own banker. The banker would take all of the client’s circumstances into account for each and every important banking transaction, and the client would often stay connected with that banker creating a relationship.

      Fast forward to today and we have a very different scenario. The size of banks and the competitive environment in which they operate has forced out the old way of doing business. Making money and having vast numbers of clients are the priorities. Good service and “human-ness” have fallen by the wayside.

      At Bayberry & Weir, we haven’t thrown out the old school style of building relationships with our clients. We offer all the advantages of a smaller law firm and we keep “human-ness” well and truly alive.

    When it comes to buying a product, it makes good sense to shop around for the best price. After all, why pay more for something that will deliver the same end result?

    Services are different to products though, and the same principle does not always apply.

     

    When it comes to buying services, price is important, but so is getting great value for the price. In the case of legal services, getting good value for money is particularly important because the end result is likely to have a significant impact on your business, property and/or life.

    What does getting good value mean in terms of legal services? It means getting access to expertise, understanding and flexibility at an affordable price.

    Bigger is not always better and this is especially true when it comes to law firms.

    I stopped working with bigger firms some years ago to set up my own firm, Bayberry & Weir, and I can honestly say I’ve never looked back!

    While it’s true that I gained a lot of valuable experience at these bigger firms and I developed an excellent network, something was missing for me. That something was the personal touch.

     

    Why building relationships matters.

    When I started my own firm, I was freed from delivering legal representation in an impersonal manner. I was able to start providing the kind of legal representation I value – one where strong connections with clients are cultivated.

They stuff their calendars with more and more client appointments AND their attention is divided, even at the best of times. They tend to be slow to respond and let’s not forget, they also have their precious reputations to preserve.

    My firm is the polar opposite of the bigger firms. I am able to give my clients my full, undivided attention and I have the advantage of being able to provide a speedy service.

    Because my firm is smaller, there is a limit on the number of clients I take on at any one time. This ensures that each and every client receives the necessary time to be heard out. I don’t rush my clients. That’s not my style.

    Find a lawyer who isn’t just a legal whizz, but is also a real person. When I first meet a client, I like to get to know them, find out them and their legal problem, and talk about the different options available. For me, it is important that the client feels stable and can make their own informed decisions on how to progress.

    2. Don’t sweat the unknowns until you’ve spoken to your lawyer and found out the next steps

    While it’s hard not to play through your day in court 100 times before it happens, it doesn’t pay off to start projecting the decisions that will be made without talking to a trusted lawyer first. It is my job to seek the best possible legal outcome for you, so I like to tell my clients to leave the if’s and maybe’s to me as well.

    3. Let the system work for you.

    We all know that the law is there to protect, and to provide fair outcomes. While it isn’t always perfect, and often we hear about some bad cases, overwhelmingly our legal system gets it right and the outcome is fair for both parties. I always make every effort to make sure the law is working FOR my clients in every possible way so that we can reach the best possible outcome.

    At the end of the day, it might not be your choice to use the legal system, but sometimes it is a necessity. Just remember that even when things seem scary, or out of your control, you can have someone standing by your side and fighting for you.
